Federal Judge Orders Freedom of Kilmar Abrego Garcia from ICE Custody

A federal judge has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement is without lawful basis.

"Since his release after erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her ruling.

The situation stems from a erroneous deportation to El Salvador in March, which the government later admitted was an error. Following his repatriation to the United States to answer human smuggling allegations, he was detained in federal detention.

In her decision, the judge noted that the government lacks a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."

Context of the Case

The court challenge center on disputed claims. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this claim.

He has also entered a not guilty plea to the conspiracy counts, which are part of a separate trial in the state of Tennessee.
